An employment permit refusal is a setback, not a dead end. DETE decisions can be reviewed by a different officer, and the window is tight: 28 days from the decision, with the review itself free of charge.

10Questions on file
Q01How long do I have to appeal?

A review request must generally be made within 28 days of the refusal decision, so acting quickly is essential.

Q02Is a review always the best option?

Not always. If the refusal was due to fixable gaps, a fresh, stronger application can sometimes be faster than a review; we advise on both.

Q03How much does a review cost?

The review itself is free of charge. If you instead reapply, a new permit fee applies, though half of the original fee is refunded on a refusal, which softens the restart.

Q04Who decides the review?

The review is decided by a different DETE officer from the one who refused the original application, reconsidering the case on the same rules and the evidence you provide.

Q05How long does a review take?

A review typically takes around 8 weeks. A corrected fresh application usually runs 8 to 13 weeks, so the two routes are closer than they first appear, and the right choice depends on your grounds.

Q06What are the most common refusal reasons?

Salary below the applicable floor, an incomplete or non-compliant Labour Market Needs Test, an ineligible occupation, missing qualification evidence and mismatched details across documents are the grounds we see most, and each has a specific fix.
